The issue addressed in the article is identifying what kind of nation we live in.

Are we enlightened? Or are we still like England?

Any Constitution does indeed declare a nation Enlightened (i.e. that it has a foundation that guides the nation).

England does not have a Constitution. It is not Enlightened because the judges sit in the highest position. They are the legal kings and queens, so to speak.

A Constitution guarantees basic realities that cannot be overruled by judges. In those nations, they are not kings and queens. The Constitution is the 'dictator'.

Particularly when the wording is clear, the judges can only quote (copy and paste) the information. They can then not rule for themselves; they must quote what was established already.

The USA is a weird nation in that there is a foundation and then that foundation is ignored. As such, the USA is not Enlightened and yet points to the US Constitution to proclaim we are Enlightened.

Since both you and I know the USA, it is already well known that this nation speaks from two sides of its mouth and with a forked tongue, often aligned with the ruler of the day.

The question before us is whether that is going to be made obvious once more, or if the judges decide that they should follow the US Constitution.
